could for your neighborhood, coming up. good morning, everyone. welcome to mornings on 2. it's saturday, september 29th. i'm mike mibach. >> and i'm claudine wong. it's a spare the air day today. after a couple of cool days by the coast we're looking at a warm-up. hi, rosemary. >> good morning to you. starting with today numbers anywhere from 10 to 15 degrees above yesterday's highs. sunday will be one of the warmest days of the next few days. monday could possibly be the hottest. these numbers, some of the hottest numbers we've seen perhaps since mid june and it comes with a heat advisory. i will show you that and the numbers for your area, coming up. >> new this morning, just a few hours ago, firefighters responded to a suspicious fire at the private law office of vallejo mayor osby davis. christian is live on the building with a look at the damage and the investigation.

christian. >> reporter: as you said, fire investigators are already saying this is a suspicious fire. now that the sun is rising we're getting a better look. you can see there's a lot of damage here. looking up you can see this is the office of osby davis. this is his private practice. looking inside the building you can see just how damaging this fire was. officials were inside just a couple of hours ago trying to figure out exactly how this fire started in the first place. crews responded to the fire here at about 1:30 this morning and say when they arrived, there was an intensifier and heavy smoke filling the building. and crews tell me they were able to confine that fire to the waiting room area but also say there's extensive smoke damage throughout the building. mayor0 bee davis was here early earlier this morning as his law office burned, as was michael thompson, the attorney who shares this office space. firefighters say the fire may have been started intentionally. >> this fire at this time is under investigation, and we hope we have some more information in the coming days

as to the cause of the fire. >> looking again, you can see, we're looking inside that building. earlier, we saw fire investigators poking around in there with a device known as a sniffer, and that tests samples from the fire and analyzing them, looking for accelerants. if you pull out just a little bit, you can see folks standing in the building. these are construction people who will be boarding up the building and trying to secure it. fire officials are just getting ready to leave and clear the scene. then they'll have to secure the building to make sure folks can't get in. we will stay here throughout the morning and follow up on any developments about the efficiency fire at mayor davis's law office. live in vallejo. happening now a san jose road is expected to be closed for most of the day after a driver hit a pole knocking down several power lines. police say it appears the 18- year-old driver fell asleep at the wheel. that accident happened around 1:30, near the intersection of

almadin expressway and redmon avenue. thousands lost power, but it has been restored for most customers. we learned the morgan hill woman who allegedly abandoned her 10-year-old daughter after a shoplifting attempt was arrested. marci kuwen was with her 10 month old son when she was arrested last month. they say back on september 19th she took her daughter to a safe way store and filled her shopping cart with groceries. they say she told her daughter to wait by the exit when she got the car but when a store employee confronted the girl keelan drove off. when she was found in nevada she had her 11 month old son with her. he and his sister with r. in protective custody a 12-year-old girl killed on a busy street in navarro will be missed. >> caylee, you will be missed. we can tell she is going to be missed because you guys know how special she is. >> haley ruttily and her family

moved to navarro from new mexico just five weeks ago. they say she was riding her bike home from school when she was hit and killed by an s.u.v. yesterday friends gathered to support the family and remember the young victim. >> thinking about it was the last time i was going to ever see her. i feel really bad and she doesn't deserve this. >> police say the driver of the s.u.v. is cooperating with the investigation and they do not believe alcohol was a factor. a memorial fund is set up in haleigh's name at wells fargo bank and contributions can be made at any branch. we're told the family is planning on moving back to new mexico. san francisco police arrested a man overnight on suspicion of stabbing a person in the neck. it happened just before 9:30 last night in justin herman plaza. police say the suspect and victim got into some argument, and the suspect/ed the victim in the neck -- slashed the victim in the neck. the suspect was arrested a few blocks away. the victim was taken to the

hospital with non-life threatening injuries. thousands of cyclists from around the world blocked traffic in downtown san francisco for the 20th anniversary of critical math. that event started at 6:15 last night. two hours later cyclists had blocked the intersection of market and van nuys avenue. >> it was pretty much sort of commuters and people who like to bike recreationally. now there's a whole culture to it. >> about 50 cyclists took part in the first critical mass back in 1992. no accidents were reported at last night's event. today is also a good day to get around by bicycle, because it's a spare the air alert day. here is a live look outside. a warm-up is expected this weekend and there is some concern about unhealthy air. people are being asked to avoid driving, and outdoor activities during the hottest parts of the day. all right. your time now is 7:06, and summer is officially over, but it still feels a little like summer this weekend, i think. rosemary is saying this warm-up

we have been talking about is headed this way. right? >> today we will be several degrees warmer than yesterday. snd looks to be one of the hottest days, and again a heat advisory to talk about with that sunday. let's talk about this morning, hard to see the sunshine. we have the marine layer back with us. it's about 1500 feet deep. and it's pretty widespread. we have fog all the way into areas like san jose, santa rosa reporting fog, and this is eventually going to burn off. we have gray skies through about mid morning. by the afternoon we'll begin to feel the heat. even dealing with a southwesterly breeze at s.f.o., fairfield reporting 20 miles per hour. so not feeling that change just yet. we will eventually. if you're headed to the coliseum for the afternoon, we are talk 70s by 1:00. partly cloudy skies, and a westerly breeze. so it will be on shore, it will be cool. temperatures meanwhile, 85 for santa rosa today, 85 in napa. 91 for concord, 83 expected in fremont. 81 for mountain view.

70 degrees in the city for the afternoon. along the coastline, mid 60s in pacifica. these numbers will be notable warmer over yesterday. yesterday seemed to be a bit of a cool day. and for your weekend if you are headed to tahoe, 70s to near 80 degrees. we will have light winds and mostly sunny skies. temperatures will be on the warm side. giving you a look at what you can expect for today, mid to upper 60s in the forecast for the coastline. mid 90s for the warmer areas. notice how we begin to really heat it up sunday into monday. again, some of the hottest numbers we have seen since about mid june. on sunday, we do have a heat advisory, especially for those that are really sensitive to the heat, maybe the little ones, and our senior citizens. that to be aware of. it will hold on through monday. monday looks to be the hottest day, low 90s to low 100s in the forecast. on tuesday, just a very slight cool-down, but we do expect to warm back well above average.

afternoon highs will be in the mid to upper 90s, and then as we get in towards wednesday, a bit of a cool down, notable for the inland areas. mid to upper 80s expected with the morning fog returning to the area. again the morning fog we're dealing with at this hour will be washing away and temperatures will be heating up. we have a beach advisory to talk about if you plan on heading that way for the weekend. more on that coming up. and with the weather warming up this weekend there will be several cooling centers open in the south bay. in morgan hill the centennial recreation center is scheduled to open to the public for relief of that heat and in san jose, nine cooling centers are scheduled to open. for a list of all the locations head to ktvu.com and click on web links. in 2012 election news, neither president obama or republican nominee mitt romney are campaigning today but their running mates are taking to the stage. vice president joe biden will rally in florida around 9:00 this morning. meanwhile, republican vice presidential candidate paul ryan is in new hampshire. this is not a live picture, but

him at the event from this morning. despite the small size, new hampshire has become a key battle ground state. ryan was there just last week. the latest polls show the president ahead of mitt romney in nine battle ground states. mr. obama's biggest leads are in ohio, new hampshire, and iowa. of course, this could change in the weeks to come. the tightest races at this point are nevada and north carolina. the national average of those polled has president obama with a 49.5%, the potential vote 44% for romney. in this weekend's presidential address president obama is calling on congress to help homeowners. >> last week mortgage rates were at historic lows. but instead of helping more and more hard working families take advantage of those rates. congress was away on break. instead of worrying about you they had already gone home to worry about their campaigns. >> the president says congress has yet to act on legislation he sent them in february that

would save homeowners about $3000 a year on their mortgages. the first presidential debate is wednesday at the university of denver. right now construction crews are busyworking on the main floor, the stage and the lighting while president obama campaigns in nevada tomorrow, romney will spend the weekend preparing for that debate. watch that debate live on k.t.v.u. channel 2 wednesday beginning at 6:00. >> there are more accusations of voter fraud in florida. the state says suspicious voter registration forms have turned up in at least 10 counties. the florida republican party says it blames the firm it hired. the g.o.p. national committee paid more than $3 million to the company strategic allied consulting for voter registration and get out the vote operations. but the republican party says it fired the firm after apparent phoney registration forms started to turn up. it's 7:11, and thousands of convictions in jeopardy. what a crime lab chemist is accused of doing that has the

speak at the university of san francisco. she has already met with president obama and was presented with the highest award that congress can give during her trip to the u.s. the nobel peace prize winner spent 15 years under house arrest in mean march and was rantly elected to a senate seat. prosecutors say annie ducan faked drug test results, forged paperwork and mixed satisfactorilies at the state's police -- samples at the state's police lab. the scandal has prompted the closure of the laboratory institute in boston and the resignation of three officials. >> her actions totally turned the system on its head. >> police saw ducan tested more than 60,000 drug samples involving 34,000 defendants during her nine years at the lab. more than 1100 inmates are currently serving time in cases where she handled the samples. we have new information this morning from the court

filings released about the colorado movie theater massacre this summer. according to the documents, the university of colorado professor that shooting suspect james holmes allegedly threatened is his psychiatrist. in the filings, prosecutors say holmes and dr. lynn fenton ended their doctor/patient relationship after the threats began. prosecutors say since their relationship was terminated, a notebook holmes mailed to dr. fenton is not protected under doctor/patient confidentiality. and should be admitted as evidence. a california jury is recommending the death sentence for an arsonist convicted of killing five men who died during a southern california wildfire. the old fire began in october of 2003 in san bernadino county. over nine days, it burned 91,000 acres and destroyed 1000 buildings. the five men died of heart attacks after their homes burned or as they tried to evacuate. in 2009, ricky lee fowler was charged with igniting the fire and he will be officially

sentenced by the judge on november 16. governor brown has signed a law limiting gun owners from open leodis playing certain firearms. bill was co sponsored by san francisco assembly man tom amiano. it backs the display of unloaded rifles and shotguns outside of a vehicle. some gun rights supporters recently openly carried unloaded weapons to advocate their right to bear arms. the governor signed a similar bill last year banning the open display of handguns. the f.b.i. is investigating the fatal shooting of a san diego woman by a border patrol agent. chula vista police say the woman was being driven around yesterday afternoon on the hood of a car. they say that is when the border patrol agent opened fire. the shooting occurred about five miles north of the mexican border. so far authorities have not released information about why the woman was on the hood of that car or what provoked the agent to shoot. a memorial for six napa county service members who died in iraq and afghanistan will be dedicated today.

the memorial sculpture of a battle cross will be formally dedicated at veteran's memorial park in downtown napa. a high school senior helped develop the memorial for her senior project 19 female veterans have sued the u.s. government over the military's treatment of rape victims. the federal lawsuit filed in san francisco alleges the military doesn't do enough to prosecute service members w40 commit rape. victims also say they experienced retaliation and harassment for reporting assaults. >> i know it's really hard to speak up, especially if you're still in the military. but you aren't alone. and we're fighting for you. >> the defense department estimates 19,000 sexual assaults occurred in the armed forces last year. about 240 cases were prosecuted. governor jerry brown says he is making sure there is moreover sight of the calf national guard. he sign -- california national guard. he signed a bill cracking down on misconduct. he will appoint an inspector general with far greater authority to investigate fraud

complaints. there have been allegations of financial misdealings and improper pay for generals. the new law also provides more protections for whistle blowers reporting abuses in the guard. travis air force base could soon become more green. officials are talking to a french company about building a facility that would generate solar power to the base. travis, located in solano county, is only one of two air force bases in california with solar projects. the other one is edwards air force base in the mow has mojave desert. >> there could be more delays traveling through san francisco intreacial airport. this is the third and last weekend crews are installing new runway lights and safety systems. the work could cause delays of up to an hour. air traffic should be back to moral by 8 a.m. monday. people who live near  oakland international may hear more noise than normal this evening. the f.a.a. is testing new air traffic control technology between 4 and 9 p.m.

that could result in some louder than normal air traffic. anyone with concerns about the noise can call the airport's noise hotline there on the bottom of your screen at 510- 563-6463. allegiance air will offer nonstop flights from oakland to colorado's montrose regional airport this winner. the airline says flights will be offered wednesdays and saturdays from december 15th to april 3. the montrose airport is about 65 miles outside of telluride, and a popular airport for travelers taking ski vacations. well, giants star buster posey is recovering last night. during the pitch goes right into his neck. it actually left a seam mark on buster poe cease's adam's apple. stuff guy. he played that entire game. but afterwards, really couldn't speak except to rasp out. you can see it right there. posey also suffered food

a suspicious fire breaks out at the law office of vallejo mayor osby davis.

the search now under way for the cause. good morning, everyone. i'm mike mibach. >> and i'm claudine wong. so far mayor davis is declining to make any comment about this fire. a fire investigator has been called to the scene and christian captain is live now outside the private practice with what's going on now. christian. >> reporter: and just the last 10 minutes or so, fire crews left the location. there's actually construction crews here who are just preparing to put up some plywood, trying to board off this building. you can see just how much damage was done. that is the front of the law offices here of mayor osby davis. if you look up you can see his name on the big marquis. a great deal of damage done to that front office and investigators were on the scene trying to figure out exactly how that fire started in the first place. crews have spotted the fire here at 1:30 this morning and say when they arrived, there was an intensifier in the waiting room area and smoke filling the entire building. crews tell me they were able to confine the fire to that waiting area but again, there is extensive smoke damage throughout the building. mayor osby davis was here

recovering after being stabbed three times in front of a vallejo bar. the victim's girlfriend says the two of them were arguing outside of a bar when the suspicious man walked up. she says they did not know that individual and she got in her car and drove away. when she returned a few minutes later, her boyfriend was on the ground with three stab wounds in his back. the knife is described as -- nan with the knife is described as a white mail, 6 feet tall, 200 pounds. occupy protesters in redwood city are commemorating the moment's first anniversary. they spent the night outside of city hall and members say they plan to stay there until noon today. they say the event is peaceful and are handing out leaf lets about their causes. occupiers say there is an increasing shortage of open spaces for the public to enjoy. >> for concerned citizens to come together, and to be present on a public space because we are living in an age where our public space is becoming privatized. >> occupiers also held a peace

vigil to recognize military veterans from redwood city. in san francisco, the occupy encampment outside the federal reserve building on market street is gone, and members are now left passing out flyers. earlier this week, police cleared out the camp and arrested 45 occupiers. people walking by say they are glad the protest is over. even a few occupiers say their camp had lost its political message and was being taken over by the homeless.  family members of a man shot and killed by oakland police will hold a rally calling for an investigation into his death. allen blueford was shot in the back in may after police say he ran from officers. flies initially reported bluford died in an exchange of gun fire that injured the officer. the following day police say a gun believed to be bluford's had not been fired and the officer's injury to his foot was self-flicked. oak -- self-flicked. oakland city officials are asking retired police officers and their families to pay back millions in pension benefits.

the city sued its own pension system claiming it was miscalculating benefits and the judge ruled the officers had been overpaid since 2008. the police officers have not decided whether to appeal. the bay area's newest gambling hall wants san jose to pay up. casino matrix opened on august 8th, and it took four months longer than expected to obtain a license from the city. matrix' owners are asking for more than $10,000 in damages. san jose city attorney calls the claim, quote unfortunate. two big announcements about job losses are putting officials on the defensive about the business climate in our state. campbell's soup and comcast have both announced plans to eliminate hundreds of jobs. both companies said the business climate did not affect their decisions, but critics say the state's high wages, taxes and housing prices make it difficult for companies to do business in california. today, carmageddon the sequel is in effect on a southern california freeway. early this morning a 10 mile stretch of the 405 along the sepulveda pass on l.a.'s west

side was shut down. crews say if all goes according to plan it will remain closed until the bridge is rebuilt before monday morning. for weeks, people have been warned about the closure and asked to stay away from the area. during a similar closure last year, drivers stayed away from the 405 and the shut down was considered a success. the man accused of making an anti-islam film that sparked protests around the world has been arrested for lying about his identity. court documents show mark eustice legally changed his name from nakoula basseley nakoula in 2002 but never told federal authorities. prosecutors say he's used multiple aliases and lied to professors about it. he is ordered held without bail to see if the name change violated his probation. this afternoon a memorial is held for u.s. ambassador to libya chris stevens. stevens and three members of his attack were killed in an attack on the u.s. consulate on september 11th. today's moment is silence is

held during the u.c. berkeley arizona state football game. stevens graduated from u.c. berkeley in 1982 with a bachelor's degree in history. this morning, michigan police are still working to determine if the body of teamsters leader jimmy hoffa is buried beneath a home in detroit. yesterday, all eyes were on the home as police removed two soil samples from underneath a shed. they were acting on a tip from a man dying of cancer who says he saw a body being buried at the home around the time hoffa disappeared. a scan of the area showed something under a concrete slab, but police are not sure what exactly it is. >> it could be a dead body. if not hoffa, then somebody else. or it could be the root of a tree. who notice. >> police say the soil samples are being tested for traces of human remains, and that nothing else was found during the dig. hoff that was last seen outside -- hoffa was last seen outside a restaurant in suburban detroit back in 1975. new this morning, it's

official. the n.f.l. referees have approved a new eight year contract. now that contract comes after a three-month lockout that made headlines when replacement referees made a highly controversial call that gave the seahawks a win over the packers. one referee called the hail mary pass a touchdown while the other ruled it was an interception. the new contract calls for referees salaries to rise to $173,000 in 2013. and to $205,000 by 2019. parts of texas are experiencing some of the worst flooding in history. torrential rains came down on midland yesterday, shutting down a school district and several roads. dozens of cars as you can see there. they were stranded under underpasses that were filled with 5 feet of water. several people did have to be rescued and more rain is expected today. no rain expected today in the bay area. in fact, it should be a very warm day across much of the bay area, and if you don't like these warm temperatures, rosemary, you'll probably not like tomorrow or monday. >> right. it will hold on for a few days.

a little heat spell coming this way. today will be hotter and drier outside our doors this morning. the marine layer right about 1500 feet and fairly widespread, into livermore this morning. concord partly cloudy, and a live look from the roof cam, you can see over the oakland estuary, plenty of gray in that fog being pinned closer to the ground, visibility down to less than a mile in areas like santa rosa. so the high pressure that is beginning to build in, sinking air associated with it, and that's why the fog deck is very close to the ground and poor visibility this morning. so morning fog and clouds. by the afternoon, the warm-up will begin. this morning, anywhere from 2 to 3 degrees from where we started yesterday morning. some of us slightly warmer, some of us slightly cooler, but by the afternoon, 5 to 15 degrees warmer than yesterday afternoon, as mike mentioned, sunday and monday, look to be the hottest days. so for today, these are some of our hottest numbers, into the low to mid 90s, and then by tomorrow, upper 90s to near 100.

good morning to you. a live look from bay point this morning. the sunshine attempting to burn through those clouds. hotter, drier conditions will come into the bay area for your weekend. police evacuated an east bay park after they say a suicidal man began making threats. the incident happened yesterday afternoon at the san leandro marina park. police took the man to the hospital to be checked out after he started cutting his arms with a knife. they say a gun he was carrying turned out to be a replica. today volunteers from bank of america are expected to join the search for a missing teenager sierra lamar. in just about 15 minutes volunteers can begin registering to join that search. registration is being done at the sierra search center at

burnett elementary school in morgan hill. lamar was last seen the morning of march 16th. antolin garcia torres has been arrested for the kidnapping and murder. the woman accused of nursing student michelle le's style begins. le disappeared on may 27th, 2011 and her body was later found on september 17th. jill esteban is accused in her murder. prosecutors say esteban blamed le for ruining her relationship with the father of her child. esteban's trial is expected to last for a month. in connecticut police say it will take weeks to investigate the circumstances surrounding a man who shot and killed his adopted son. authorities say the 15-year-old high school sophomore apparently tried to ransack his own house. he had a knife, wore a ski mask and was dressed in all black. the father thought the teen was a prowler. the two started fight each other and before the father shot and killed his adopted son. the boy's classmates say he was a sweet, fun loving person. the vatican opened the

doors today for the public trial of the most embarrassing scandal of pope benedict xvi's papacy. the pope's butler is accused of stealing and leaking pay pal correspondence to journalists. 46-year-old paolo gabriel faces up to four years in prison if he is convicted of aggravated theft. he's already questioned and asked to be par -- confessed and asked to be partnered boy the -- pardoned by the pope. a stolen painting worth thousands has turned up more than 60 years later. in 1961 this painting by pierre renoir was lifted from the museum of art. the painting vanished until 2010 when an unknown woman paid $7 for a box at a flea market in west virginia. inside that box was a doll, a plask cow and the missing -- plastic cow and the missing painting. >> this is just what we all fantasize about. finding a great treasure unknown somewhere. >> the painting is worth between 75 and $100,000. lawyers are now trying to determine if the painting is the rightful property of the

woman w40 bought it for $7, the museum, or the insurance company who paid out the claim when the painting was stolen. some of jesse jackson, jr.'s constituents are starting to lose patience with his leave of absence. more than three months have passed since the illinois congressman mysteriously disappeared, and election day is five weeks away. jackson's campaign eventually revealed that he was being treated for by polar disorder, and gastrointestinal problems. they say he has no plans to leave the race, and his name is still on the ballot. well, some same sex couples are getting some relief from the federal government. now couples in which a partner is an illegal immigrant will have their deportation put on hold. yesterday the department of homeland security issued a memo saying it will spend its resources on illegal immigration cases with higher priority. a warning this morning from the f.d.a. about fake online pharmacies. the 23á d.a. has launched a new campaign to alert the public about the

dangers of buying medications online. the f.d.a. says the vast majority of internet pharmacies are fraudulent and selling drugs that are fake, expired, or do not contain any active ingredients. some medications have also been found to contain arsenic, and even rat poison. a new report finds amtrak employees are failing drug and alcohol tests at a much higher rate than the rest of the rail industry. the audit from amtrak's office of inspector general found amtrak employees are failing the test at a 51% higher rate than the industry average. the majority of employees who fail drug tests tested positive for marijuana and cocaine. governor brown is green lighting forms to red light cameras. he signed a new law that sets uniform standards for red light cameras. they must be installed at locations to ensure safety, not for cities to raise revenues. warning signs must be posted within 200 feet of a camera and it will be easier for drivers to challenge tickets. palo alto state senator joe

siminian authored the legislation. for the second year the governor is vitoing a bill that would raise the fine for illegal use of cell phones. it would increase the base fine from $20 to $30. governor brown says he believes the current fines and penalties which can get as high as 33 sixes are already a powerful deterrent. he does not believe that raising them will reduce the amount of violations. one of the biggest high- tech events in san francisco begins tomorrow. oracle's open world will be held at mosconi center. more than 50,000 people are expected to attend that conference. it will include discussions about industry trends and future technology. oracle ceo larry ellison is expected to unveil a new database system. open world runs through next thursday. for the first time, insta gram is reporting more users than twitter. the free photo sharing app reported having 7.3 million daily users in august. a big jump from march when it had less than 900,000 users. twitter had just 6.9 million users in august.

of asissi. we have a traffic alert. if you plan to ride bart out of pleasant hill, bart will be water proofing the track and platforms at the station. they want to complete the work before the winter months. that means there will be no trains on platform 1 this weekend. passengers traveling to pittsburg pay point will need to board from platform 2. there's concern that pitcher dallas braden might let his emotions get the better of him. during an anti-violence rally in stockton wednesday, he got into a heated exchange with the stockton police chief about a recent crime wave. now the chronicle reports braden had to complete an anger management program for a suspected road rage incident near livermore last year. braden admitted to spitting and throwing coffee on the car of a woman who changed lanes in front of him. braden pleaded no contest, paid as 1000 fine, and attended 10 anger management classes. the oakland a's just need to win four of their last five games to earn that playoff

tuolumne street near the superior court house. the building was heavily damaged as you can see, firefighters on scene clearing that out. firefighters battled the flames from both the street as well as on top of the roof. the scene had been taped off for a long time this morning and an arson investigator has been called to the scene. crews are calling the fire suspicious. >> yeah. heavy smoke and fire coming from the windows. the front window, waiting areas, crews aggressively attacked the fire, we were able to stop the fire and contain it. >> you can see there is the mayor in the ball cap. he was on the scene earlier this morning checking out the damage himself. he's so far declined to talk to the media. davis does share that building with another attorney. we'll have a live report from vallejo in our next half hour. happening in san jose, a roadway is expected to be closed for most of the day after a driver hit a pole knocking down several power lines. police say it appears the 18- year-old driver fell asleep at the wheel. the descend the intersection of

almadin expressway and redmon avenue. thousands lost power overnight but power has been restored for most of those customers. in overnight news, the morgan hill woman accused of using her 10-year-old daughter in a shoplifting scam and then leaving her at the store has now been arrested. marci keelin was arrested last night at a motel east of reno. she was found with her 11 month old son after a sheriff's deputy spotted her car. police say on september 16th, she took her daughter to a safe way store, filled a cart with groceries, and then told her daughter to wait by the exit while she went and got her car. a store employee actually confronted that door and that's when keelin allegedly drove off. her children are placed in protective custody. a 12-year-old girl who died after being hit by an s.u.v. on a busy novato street is being represented by family and friends. >> haley, you will be missed, and we can tell that she's going to be missed, because you guys know how special she is.

>> on thursday, hailey ratliff was riding her bicycle home from school and police say she collided with an s.u.v. on novato boulevard. yesterday a vigil was held to support the family, who has only lived in the area for a short period of time. >> the thing about it is the last time i was going to ever see her again. so i feel really bad, and she didn't deserve this. >> police say the driver of the s.u.v. is cooperating with the investigation, and police do not believe alcohol played a factor. a memorial fund has been set up in hailey's name at wells fargo bank. contributions can be made at any branch. we are told the family is planning on moving back to new mexico. san francisco police arrested a man overnight on suspicion of stabbing a person in the neck. that happened just before 9:30 last night at justin herman plaza. police say the suspect and victim got into an argument and then the suspect slashed the victim in the neck. the suspect fled but was arrested just a few blocks away. the victim was taken to the

hospital with non-life threatening injuries. thousands of cyclists from around the world blocked traffic in downtown san francisco for the 20th anniversary of critical mass. the event started at 6:15 last night. two hours later cyclists had blocked the intersection of market street and van nuys avenue, cutting off traffic to two of the main thoroughfares. >> before, the culture was pretty much sort of commuters and people liked to bike recreation ali. now there is a whole culture to it. just >> just about 50 cyclists took part in the first critical mass back in 1992. no accidents were reported at last night's event. well, there is a spare the air alert in effect today. we want to take you outside for a live look at walnut creek. there you can see the sun is just moving out there already, and it's going to warm up pretty quickly. as rosemary's told us, the heat- up is coming. there's concern that pollution could get to unhealthy levels, so people are asked to avoid

fair ground, injuring 35 people -- excuse me. local media is reporting that the fair was closed at the time and the injured people were all fair employees. a curfew was in effect overnight in saddam hussein's hometown as authorities frantically searched for dozens of escaped inmates. officials say 16 inmates and four guards were killed in a jail break at a prison in tikrit yesterday. it's believed more than 100 inmates escaped including 47 linked to al qaeda, who were awaiting execution. just a couple dozen have been recaptured. authorities say they believe some guards may have assisted in that jail break. a scandal involving a massachusetts crime lab chemist could put thousands in question. annie ducan they say faked drubbing test results, forged paperwork and mixed samples. it's prompted the closure of the hindon state laboratory institute in boston and the

resignation of five officials. >> her actions totally turned the system on its ahead. >> they say she tested more than 50,000 drug samples involving 34,000 defendants during her nine years at that lab. more than 1100 inmates are currently serving time in cases where she handled the samples. we have new information this morning that the university of colorado professor allegedly threatened by shooting suspect james holmes was his therapist. according to court filings, prosecutors say holmes accused of opening fire at a movie theater and killing 12 people and his therapist dr. lynn fenton ended their relationship when the threats began. prosecutors say since the relationship was terminated, a notebook holmes mailed to dr. fenton is not protected under doctor/patient confidentiality and should be admitted as evidence. an arsonist convicted of killing five men during a southern california wildfire is being recommended for the death penalty. the fire began in october of 2003, in san bernadino county. over nine days it burned 91,000 acres and destroyed 1000

buildings. five men died of heart attacks after their homes burned or as they tried to evacuate. in 2001, ricky lee fowler was charged with igniting the fire and he will be officially sentenced by the jung on november 16th. governor brown has signed a law limiting gun owners from open leodis playing certain firearms. the bill was co sponsored by san francisco assembly man tom amiano. it bans the display of unloaded rifles and shotguns outside of a vehicle. some gun rights supporters recently openly carried unloaded weapons to advocate their right to bear arms. the governor signed a similar bill last year banning the open display of handguns. a san diego woman is dead after being shot by a border patrol agent. chula vista police say the woman was being driven around yesterday afternoon on the hoot of a car. they say that is when the border patrol agent opened fire. the shooting occurred just about five miles north of the mexican border. so far, authorities have not said why the woman was on the hood of the car, or what

provoked the agent to shoot. the f.b.i. is now investigating the case. a memorial for six napa county service members who died in iraq and afghanistan will be dedicated today. that memorial schupter of a battle cross will be dedicated at veteran's memorial park in downtown napa. a napa high school senior helped develop the memorial for her senior project 19 female veterans have sued the u.s. government over the military's treatment of rape victims. the federal lawsuit filed in san francisco alleges that the military doesn't do enough to prosecute service members who commit rape. victims also say they experienced retaliation and harassment for reporting assaults. >> i know it's really hard to speak up, especially if you're still in the military. but you aren't alone. and we're fighting for you. >> the defense department estimates 19,000 sexual assaults occurred in the armed forces last year. only about 240 cases were prosecuted.

governor jerry brown says he is making sure there is moreover sight of the california national guard. he signed a bill aimed at cracking down on misconduct. he will appoint an inspector general with far greater authority to investigate fraud complaints. there have been allegations of financial misdealings and improper pay for generals. the new law provides more protection for whistle blowers reporting abuses in the guard. travis air force base could soon become more green. officials are talking to a french company about building a facility that would generate solar power to the base. travis located in solano county, is only one of two air force bases in california with solar projects ongoing. the other is edwards air force base in the mojave desert. there could be more delays in store for people traveling through san francisco international airport this weekend. this is the third and final weekend crews will be working on the installation of the new runway lights and safety systems. that work can cause delays of up to an hour, but air traffic should be back to normal by 8 a.m.

well, a teenager in michigan is getting the last laugh after she was nominated to her high school homecoming court as a joke. last night, 16-year-old whitney kropp, there she is, she took the field during half time of her school's homecoming game to cheers of hundreds of supporters. she says when she first found out she had only been nominated

as a joke she was crushed and had thoughts of suicide. but her sister convinced her to keep her title on the court. >> i thought, you know, not even my own brother and sister care. but they are proving to me they do care. the world is proving that they -- well not really care about me but they care about the situation. >> good for her. to show support, a facebook page was launched telling whitney's story and people rallied behind her. people from other high schools in the area even missed their own homecoming games to see her big moment. she says she hopes her story will inspire others to ignore bullies and do what makes you happy. more than 2000 soccer balls will hopefully be flying in the air out at candlestick today. america scores, a local youth soccer group will gather to try to break the guinness world record for the most soccer balls dribbled at one time. last year the st. louis chapter made history when 428 soccer players came together. but the united nations has since defeated that record with more than 2000 dribblers in the gaza strip.

top stories this morning. a morgan hill woman is in jail after allegedly abandons her 10- year-old daughter after a shoplifting attempt. marci keelin was arrested last night east of reno. she had her 11 month old son with her when she was taken into custody. police say on september 19th she took her daughter to that safe way store, filled up a shopping cart with groceries. police say a store employee confronted the girl when the mom went out to try to get the car and that's when the mom drove off. a san jose road is expected to be closed after a driver hit a pole knocking down several power lines. police says it appears the driver fell asleep at the wheel. thousands lost power overnight but power has been restored for most customers. >> and fire crews are trying to figure out what caused a fire at the private law office of vallejo mayor osby davis. christian kaplan is live at the building on tuolumne street with more on why they're calling this fire suspicious. hi, christian. >> reporter: good morning. in the last hour or so, fire crews cleared the scene here, so we have been able to move in

and get a closer look at the scene. you can see there are construction workers working to board up the windows and secure the scene here. from our vantage point looking inside, you can actually see a lot more of the damage that happened inside of this building. right now an intensive investigation is under way here at vallejo, mayor osby davis's law offices. crews responded to the fire here at 1:30 this morning, and say when they arrived, there was an intensifier and smoke filling the building. mayor osby davis was here earlier this morning, surveying the damage for himself, as was fellow attorney michael thompson, who shares this law office and tells us he is devastated by the fire. crews tell me they were able to confine that fire to the waiting area but that there was extensive smoke damage throughout the building. firefighters say this fire may have been started intentionally, and earlier this morning we saw investigators going through the scene with a device that could help them figure out exactly how this fire started. >> we've used it, i'll call it, refer it to as a sniffer, and what that does, it will pick up

any flammable liquids, or other things like that as to -- and that gives an indication of how the fire started, as well as traveled. >> reporter: coming back to our live picture to give you a little context here, in 2010 i covered a suspicious fire directly across the street from the court -- from osby davis's offices in the solano county justice building. the court building right there, and that investigation, investigators caught two suspected arsonists in that case. one of the tools that may help investigators in this case are these surveillance cameras here, directly across the street from today's fire. you can see how they could easily have a very good view of the scene of this morning's fire. we will try to get in contact with investigators to find out if they have been able to pull usable video from the cameras. for now live in vallejo, christian cap lan, ktvu. family members of a man shot and killed by oakland police will hold a rally calling for an investigation into his death in in play allen bluford was shot after police

say he ran from officers. police initially reported he died in an exchange of gun fire that injured the officer. the following day police said a gun believed to be bluford's had not been fired and the officer's injury to his foot was self-flicked. vallejo police are looking for a man accused of stabbing someone in front of a bar. they say they were arguing outside of a bar on tuolumne street when an unidentified man walked up. she says they didn't know who he was. she got in the car and drove away. when she returned her boyfriend was on the ground withfully stab wounds to his back. the person who stabbed him is described as a white man, six feet tall, 200 pounds wearing a black hoody and a black and white hat. occupy protesters in redwood city are commemorating the moment's first anniversary. they did that by spending the night outside of city hall and members plan to stay there until noon today. we just got off the phone with redwood city police. they tell us everything was peaceful and there were no

problems overnight. occupiers say a central message this weekend is raising awareness about the shortage of open spaces for the public to enjoy. >> for concerned citizens to come together, and to be present on a public space, because we're living in an age where our public space is becoming privatized. >> occupiers also held a peace vigil to recognize military veterans from redwood city. in san francisco, the occupy encampment outside the federal reserve building on market street is gone. members are still there passing out flyers. earlier this week, police cleared out the camp and arrested 45 occupiers. people walking by say they're glad the protest is over and even a few occupiers say their camp had lost its political message and was being taken over by the homeless. we are learning more about the charges facing the man accused of making an anti-islam film that sparked protests around the world. court documents show mark yusef

legally changed his name from nakoula basseley nakoula in 2002, but never told federal authorities. prosecutors say he used multiple aliases, and lied to probation officers about his real name. yusef was ordered jailed without bail until a hearing to see if the name change violated terms of his probation on bank fraud charges. that anti-muslim fuel is being blamed for an attack on the u.s. consulate in libya that killed ambassador chris stevens and three members of his staff. to honor stevens a moment of silence will be held during today's u.c. berkeley/arizona state football game at memorial stadium. stevens grads waited from u.c. berkeley in 1982 with a bachelor's degree in history. 30 minutes ago, registration began to continue to search for a missing teenager sierra lamar. today's group is expected to include people from bank of america. people 18 and over can register at burnett elementary school in morgan hill. lamar was last seen on the morning of march 16ths.

ant lynn garcia torres has been arrested for her kidnapping and murder. a trial begins monday for the woman accused of murdering michelle le on may 27, 2011. her body was found a couple months later on september 17th. giselle esteban is accused of her murder. prosecutors say esteban blamed le for ruining her relationship with her child's father. the trial is expected to last a month. oakland city officials are asking retired police officers and their families to pay back millions of dollars in pension benefits. the city sued its own pension system, claiming it was miscalculating benefits, and a judge ruled the officers had been overpaid since 2008. the police officers have not decided whether to appeal. well, the bay year's newest gambling hall wants san jose to pay up. casino matrix opened doors on august 8th, but that was four months later than expected, because it took that long to get the license from the city.

considered a success. bay area commuters are going to have some new options starting monday. cal trans is adding two new trains and restoring four others that were cut due to budget constraints. the altamont commuter express is adding two new trips between the san joaquin and tri valley areas to san jose. cal train says rider ship reached an all time high in june, leading to standing room only trains on some routes. we also have a transit alert this morning if you no one ride bart out of pleasant hill. today bart will be water proving the track in platforms at the station. and they want to get that work done before the winter months. that means there will be no trains, there are going to be no trains on platform 1 this weekend. passengers traveling to pittsburgh bay point will need to board on platform 2. other closures are expected during the next four weekends. >> there is concern that a's pitcher dallas braden might be playing a little hard ball off the field. during an anti-violence rally in stack on the on wednesday -- stockton on wednesday braden

got into a heated exchange with the stockton police change about a recent crime wave. now the chronicle reports braden had to complete an anger management program after a suspected road rage incident near livermore last year. braden did admit to spitting and throwing coffee on the car of a woman who changed lanes in front of him. braden plead nod contest, paid a $1000 fine and attended 10 anger management classes. the a's need to win four of the last five games to earn a spot in the playoffs. that is after an exciting game last night here against the mariners. despite a battle with pink eye for two weeks, coco crisp was on a hot streak. 1st inning, a solo shot. crisp had three hits and scored three times. the a's beat seattle 8-2. brandon mccarthy won't pitch again this season but he has been cleared to be in the dugout for the a's final home stand of the season. he made that announcement yesterday during his first meeting with the media since being hit in the head with a

after he started cutting his arms with a knife. they say a gun he had was a replica. despite a promising lead it appears the whereabouts of jimmy hoffa's body will remain a mystery. yesterday all eyes were on a home in detroit as police removed two soil samples from underneath a shed. they were acting on a tip from a man dying of cancer who says he saw a body being buried at the home around the time hoffa disappeared. a scan of the area showed something under a concrete slab, but police are not sure what exactly it is. >> it could be a dead body, if not hoffa, then somebody else, or it could be the root of a tree. who knows. >> police say the soil samples are being tested for traces of human remains and nothing else was found during that dig. hoffa was last seen outside a restaurant in suburban detroit back in 1975. in connecticut, police say it will take weeks to investigate the circumstances surrounding a man who shot and killed his adopted son. authorities say the 15-year-old high school sophomore

apparently tried to ransack his own house. he had a knife, he wore a ski mask and was dressed in all black. the father did not know the prowler was his adopted son. the two started fighting each other right before the father shot and killed him. the boy's classmates say he was a sweet, fun-loving person. if you have unwanted prescription medicine in your home, today is the day to get rid of it. san francisco, dublin and the san mateo police departments are taking part in a nationwide prescription drug take-back day. the event goes from 10 a.m. to 2 p.m. and people in san francisco and san mateo can drop off medicine at various police stations. residents of dublin, that collection will be taking place at civic center plaza. a warning this morning from the f.d.a. about fake online pharmacies. the f.d.a. has launched a new campaign to alert the public about the dangers of buying medications online. the f.d.a. says the vast majority of internet pharmacies are fraudulent and selling drugs that are either fake, expired, or do not contain any

active ingredients. some medications have also been found to contain ar sen nick and rat poison. it's that time of year, time for the flu shot. today more than 1000 people are expected to use the drive through clinics at kaiser permanente in union city and fremont. last year 1100 kaiser patients came to get their flu shots at the popular drive through clinics, and the clinic opens in just about 12 minutes at 9 a.m. governor jerry brown has until tomorrow to sign or vito a bill regarding mandatory child vaccinations. the bill would require parents to get a signed waiver from a doctor to opt out of required  school immunizations. opponents say it's a veiled assault on freedom, because some parents opt out for medical or religious reasons. supporters say all kids should be vaccinated, and the bill would make this harder to avoid. well, kodak is mapping out a new plan in hopes of emerging from bankruptcy protection. the in company wants to stop selling consumer ink yet

printers and eliminating 200 more jobs than previously projected. kodak filed for bankruptcy protection in january. the company already announced it's stopping the production of cameras, pocket video cam extras digital picture frames. kodak has cut 2700 jobs and will now eliminate 1200 more. talks between n.h.l. players and owners continue this morning. we'll tell you what was accomplished during a recent meeting and what that could mean for the already delayed season. hotter, drier conditions will settle into the bay area for your weekend. i'll have a look at your numbers coming up. the vatican opened the doors today for the public trial of an embarrassing scandal for pope benedict xvi. the pope's butler is accused of stealing and leaking information pertaining to the pope to a journalist. 46-year-old paolo gabriel faces four years in prison if he is convicted. he's already confessed and has asked to be pardoned by the pope. a federal government has good news for some same sex couples. couples with one partner who is an illegal immigrant will now have their deportations put on hold. yesterday, the department of homeland security issued a memo saying it will spend its resources on illegal immigration cases with higher priority. a new report finds amtrak employees are failing drug and alcohol tests at a much higher rate than the rest of the rail industry. the office of inspector general found amtrak employees are failing the tests at a 51%

higher rate than endures average. the majority of employee loss fail drug tests tested positive for marijuana and cocaine. governor brown is green lighting reforms to red light cameras. he's signed a new law that sets uniform standards for those red light cameras. they must be installed at locations to ensure safety, not for cities to raise revenues. warning signs have to be posted within 200 feet of a camera, and it's also going to be easier for drivers to challenge those tickets. palo alto state senator joe siminian authored the legislation. >> if you are in the market for an electric car this may be a good time to buy or lisa a nissan leaf. nissan is lowering mollies prices to 219 from 249 and offering discounts due to slow sales. nissan says it's sold more than 42 run leafs this year through august. almost a third fewer than a year ago. well, one of the biggest high-tech events in san francisco begins tomorrow. oracle's open world will be held at mosconi center.

more than 50,000 people are expected to go to the conference and it will include discussion about industry trends and future technology. oracle c.e.o. larry ellison is expected to unveil a new database system. open world runs through next thursday. new this morning, it is official. the n.f.l.'s referees have approved a new eight-year contract. that contract comes after a three-month lockout that made headlines when replacement referees made a highly controversial call that gave the seahawks the win over the packers. one referee called that hail mary pass a touchdown, while the other ruled it an interception. the new contract calls for referee's salaries to rise to $173,000 a year in 2013. and then to 205,000 by 2019. the n.h.l. and the players union have begun another round of talks this morning. the league has already canceled the entire preseason due to a labor dispute and lockout. today's negotiations are not expected to focus on if core issues involving players' salaries and revenue sharing.

we have an advisory to talk about. i'll show you your numbers, coming up. in overnight news, a suspicious fire broke out at the private law office of vallejo mayor osby davis. flames started in a waiting room, then went up to the roof. christian calf tan captain has more. >> reporter: the construction crews are at work right now, just about finished with the front part of this building here, securing the building, trying to prevent people from getting in later on throughout the day. you can see the extensive damage on the inside of the building. we can tell you there is an intensive investigation under way at the vallejo mayor's law offices. crews responded to the scene here at about 1:30 this morning and say when they arrived, there was an intense fire and smoke filling the building. mayor davis was here earlier this morning, surveying the damage for himself, as was fellow attorney michael thompson, who shares the office

here. he tells ktvu he was devastated by the fire. firefighters say this fire may have been started intentionally. we saw investigators going through the scene with a device that could help them figure out exactly how this fire started. a sniffing device can detect accelerants. crews were able to confine the fire to the waiting area and knock to down within about 15 minutes and that should help in the investigation. >> because sometimes it's very difficult to locate and, you know, figure out how these things start. but, again, like i said, because we were able to do a very efficient job, it makes it easier for them to do an efficient job as well. >> reporter: in 2010, i covered a fire at the solano county court building across the street. investigators were able to find two suspects in that case. now, in this case, one of the things that may well help this investigation are those surveillance cameras up there on the building directly across the street. as you take a look over here, you may see they would probably have a very good view of the fire here at the scene. so far, we haven't learned whether or not investigators

have found any usable information on that videotape. but we'll continue to try to pursue that avenue and find out what they found out about the suspicious fire here at the vallejo mayor's private law offices. christian calf tan, ktvu channel 2news. san jose roadway is expected to be closed for most of the day after a driver hit a pole, knocking down several power lines. it appears the 18-year-old driver fell asleep at the wheel, according to police. the accident happened around 1:30 near the intersection of almondton expressway and redmond avenue. thousands of people did lose power overnight, but power has been restored for most customers. overnight, we learned that the morgan hill woman who allegedly abandoned her 10-year-old daughter after a shoplifting attempt was arrested. marcy keelin was taken into custody last night at a motel east of reno. police say on september 19th, she took her daughter to a safeway store and filled a shopping cart with groceries. they say she told her daughter to wait by the exit while she got the car, but when a store

employee confronted the girl, keelin drove off. police say when she was found in nevada, she had her 11-month-old son with her. he and his 10-year-old sister are both now in protective custody. san francisco police arrested a man overnight on suspicion of stabbing a person in the neck. it happened just before 9:30 last night in justin herman plaza. police say the suspect and the victim got into some type of argument and the suspect slashed the victim in the neck. the suspect fled, but was arrested a few blocks away. the victim was taken to the hospital with nonlife threatening injuries. family members of a man shot and killed by oakland police will hold a rally today, calling for an investigation into his death. alan bloomford was shot back in may, after police say he ran from officers. police initially reported that blufffield died in an exchange of gunfire that also injured an officer. the following day, police said a gun believed to be blufffield had not been fired and the officer's injury to his foot was

self inflicted. nobel peace prize winner makes a stop in the bay area today, at the university of san francisco after being honored at the san francisco freedom forum last night. she has met with president obama and was presented with congress' highest award during her trip to the u.s. the nobel peace prize winner spent 15 years under house arrest in myanmar and was recently elected to a seat in parliament. in election 2012 news this morning, neither president obama nor republican nominee mitt romney are campaigning today. that means their running mates are taking center stage on this saturday. vice president joe biden at a rally in florida. this is a live picture from that event from fort myers. let's take a time here to listen in. >> -- you're hearing the talk about simpson bowles, leading democrats and republicans, every one of those plans, they reject them. paul ryan even voted against the

the average percentage of the polls is 49.5% for president obama, 44% for romney. in this morning's weekly address, president obama is calling for congress to help homeowners. >> last week, mortgage rates were at historic lows, but instead of helping more and more hard working families take advantage of those rates, congress was away on break. instead of worrying about you, they had already gone home to worry about their campaigns. >> the president says congress has yet to act on legislation he sent them in february that would save homeowners about $3000 a year on their mortgages. the first presidential debate will be held at the university of denver this wednesday. construction crews are currently working on the main floor, the stage, as well as the lighting. incidentally, wednesday is president and michelle obama's 20th wedding anniversary. republican presidential nominee mitt romney is spending this weekend preparing for the debate. you can watch that debate live on ktvu channel 2 wednesday

in the first one in 1992. no arrests or accidents reported at last night's event. the state of florida says suspicious voter registration forms have turned up in at least 10 counties. the florida republican party says it blames the firm it hired. the gop national committee paid more than $3 million to the company, strategic allied consulting, for voter registration and get out the vote operations. but the republican party says it fired the firm, after apparent phony registration forms started to turn up. in two hours, local dog owners willmar against mitt romney. they are protesting mitt romney's treatment of his dog sheamus. they say during a family trip to canada in the 1980s, romney put sheamus into a crate on top of a car. they say the dog was subjected to near-hurricane force winds. today's event begins at 11:30 at richmond's point isabelle regional park. new this morning, former "new york times" publisher has died at age 86.

the paper said the long-time publisher died today at his home in new york, after a long illness. he retired in 1992 after three decades at the paper and was succeeded by his son, arthur, jr. the paper won more than 30 pulitzer prizes and won a key legal ruling during his time as publisher. . new information this morning about mass shooting suspect james holmes and threats he allegedly made before the colorado theater shooting. now, according to court documents, it appears those threats were targeted at his therapist. prosecutors say holmes' therapist, dr. lynn fenton ended their relationship when threats began. prosecutors also argue that because their relationship was terminated, a notebook holmes mailed to dr. fenton is not protected under doctor/patient confidentiality and should be admitted as evidence. well, 19 female veterans have sued the u.s. government over the military's treatment of rape victims. the federal lawsuit filed in san francisco alleges the military does not do enough to prosecute service members who commit rape.

victims also say they experienced retaliation and harassment for reporting assault. a memorial for six napa county service members who died in iraq and afghanistan will be dedicated today. the memorial sculpture of a battle cross will be formally dedicated at veterans memorial park in downtown napa. a napa high school senior helped develop the memorial for her senior project. governor jerry brown says he is making sure there is more oversight of the california national guard, cracking down on misconduct. he will appoint an inspector general with far greater authority to investigate fraud complaints. there have been allegations of financial misdealings and improper pay for generals. the new law also provides more protections for whistle blowers reporting abuses in the guards. controversial move made by the governor. we'll tell you what has some gun owners upset this morning. >> and notable hike in temperatures is on the way for the weekend. what you can expect for your

demonstration. parts of texas are experiencing some of the worst flooding in its history. check that out. torrential rains came down on midland, texas yesterday, shutting down a school district and several roads. dozens of cars and trucks were stranded and underpasses were filled with about 5 feet of water. several people did have to be rescued. and guess what? more rain is expected today. more bodies are being recovered following yesterday's flash flood in southern spain. rescue crews say the death toll is now at eight. the severe weather also caused a tornado to form and sweep through a fair, injuring 35 people. local media reported the fair was closed to the public and that the injured people are fair workers. california jury is recommending the death sentence for an arsonist convicted of killing five men who died in the southern california wildfire. the old fire began in october of 2003 in san bernardino county.

over nine days, that fire burned 91,000 acres and destroyed 1000 buildings. the five men who died actually died of heart attacks after their homes were burned or as they were trying to evacuate that area. back in 2009, ricky lee fowler was charged with igniting the old fire. he has been convicted and will now be officially sentenced by the judge on november 16th. the fbi is investigating the fatal shooting of a san diego woman by a border patrol agent. police say the woman was being driven around yesterday afternoon on the hood of a car. they say that is when the border patrol agent fired his weapon. the shooting occurred just about five miles north of the mexican border. so far, authorities have not said why the woman was on the hood of the car or what provoked the agent to shoot. governor brown has signed a law limiting gun owners from openly displaying long firearms. the bill was cosponsored by san francisco assemblyman tom omiano, banning the display of

unloaded rifles and shotguns outside of a vehicle. gun rights supporters recently carried unloaded weapons to advocate their right to bear arms. the governor signed a similar bill last year, banning the open display of handguns. tomorrow is the deadline for governor jerry brown to sign or to veto a bill regarding mandatory child vaccinations. the bill would require parents to get a signed waiver from their doctor, if they want to opt out of required school immunizations. opponents of the bill say that's a veiled aassault on freedom. but supporters say all kids should be vaccinated and the bill would make opting out harder. general motors is recalling more than 40,000 cars because of a plastic part in the fuel pump might crack, causing a leak. the recall covers chevrolet cobalt and pontiac g5 sedans from the 2007 and 2009 model years. chevrolet equinoxes, pontiac torrent, and saturn ion from the 2007 model year are also included. so far, no reports of fires from

those leaks. well, there could be more delays in store for people traveling through san francisco international airport this weekend. this is going to be the third and the last weekend that crews will be working on the installation of new runway lights and safety systems. the work could cause delays of up to an hour. but air traffic should all be back to normal by 8:00 a.m. on monday. people who live near oakland international airport may hear more noise than normal this evening. the faa is testing new air traffic technology between 4:00 p.m. and 9:00 p.m. that could result in louder than normal air traffic and anyone with concerns about the noise can call the airport's noise hotline there at the bottom of the screen, 510-563-6463. allegiant air will offer nonstop flights from oakland to colorado's montrose regional airport this winter. the low cost airline says flights will be offered wednesdays and saturdays from december 15th to april 3rd. the montrose airport is about 65 miles outside of telluride and a popular airport for travelers

doesn't deserve this. >> police say the driver of that suv is cooperating with the investigation. they don't believe alcohol played a factor. and memorial fund has now been set up in haley's name at wells fargo bank. you can make contributions at any branch. we are told the family is planning on moving back to new mexico. a man is recovering this morning after being stabbed three times in front of a vallejo bar. the victim's girlfriend says the two of them were arguing outside of a bar when a man walked up to them. she says they did not know that individual and she got into her car and drove away. when she returned just a few minutes later, her boyfriend was on the ground with three stab wounds to his back. the suspect is described as a white man, 6 feet tall, 200 pounds, wearing a black hoodie and black and white hat. an occupy protest in redwood city will wrap up at noon today. demonstrators spent the night outside city hall. we spoke to redwood city police this morning, who told us they have encountered no problems.

occupiers say a central message this weekend is to raise awareness about the shortage of open spaces for families to enjoy. >> for concerned citizens to come together and to be present on a public space because we are living in an age where our public space is becoming privatized. >> occupiers also held a peace vigil to recognize military veterans from redwood city. and san francisco, the occupy encampment outside the federal reserve building on market street is now gone. members are now left passing out flyers. earlier this week, police cleared out the camp and arrested 45 occupiers. people walking by say they are glad the protest is over. even a few occupiers say their camp had lost its political message and was being taken over by the homeless. we are learning more about the charges facing the man accused of making an antiislam film that sparked protests around the world. court documents show the man

legally changed his name in 1992, but never told authorities. he used multiple aliases and lied to probation officers about his real name, according to prosecutors. he was ordered to jail without bail until further investigation. well, that antimuslim film, the alleged motive behind an attack on the u.s. consulate in libya that killed ambassador chris stevens and three members of his staff. to honor stevens, a moment of silence will be held during today's uc berkeley-arizona football game at uc stadium. stevens graduated from uc berkeley in 1982 with a bachelor's degree in history. right now, volunteers are continuing to search for a missing teenager sierra lamar. today's group is expected to include people from bank of america. people 18 and older can register at the sierra search center at burnett elementary school in morgan hill. lamar was last seen the morning of march 16th. antolin garcia-torres has been arrested for her kidnapping and murder. the trial begins monday for the woman accused of killing

nursing student michelle le. le disappeared on may 27th, 2011. her body was found a couple months later on september 17th. esteban is accused in her murder. prosecutors say esteban blamed le for ruining her relationship with the father of her child. esteban's trial is expected to last about a month. oakland city officials are asking retired police officers and their families to pay back millions of dollars in pension benefits. the city sued its own pension system, claiming it was miscalculating benefits and a judge ruled the officers had been overpaid since 2008. the police officers have not decided whether to appeal. well, the bay area's newest gambling hall wants the city of san jose to pay up. casino matrix opened its doors on august 8th, four months behind schedule because of a delay in getting a permit. matrix is asking the city for more than $10,000 in damages, but the san jose city attorney

calls the claim, quote, unfortunate. . good morning to you. warmer weather in the forecast for your saturday afternoon. right now outside our doors, plenty of this. we've got gray, overcast skies, high pressure building in. as it, does it's compressing the marine layer, bringing us a little patchy fog to areas like santa rosa, where visibility has been down to a mile in some cases along the coastline as well. dealing with that morning, but that high pressure is also going to be burning off these low clouds. we'll eventually get to the warmup and plenty of sunshine by the afternoon. temperatures today, anywhere from 5 to 10 degrees to 15 degrees above what we felt on friday. and this is the beginning of the warming trend. we are going to hit 100 degrees in some areas by sunday, into monday. and monday looks like it could be the hottest day. not only the hottest day of the next few days, but perhaps some of the hottest weather we have seen since mid-june. with the light winds and the very hot weather mixed with the

low level pollution, we've got poor air quality in some areas. moderate to a bit unhealthy for today, and a spare the air day has been declared for the entire bay area, but it is the eastern inner district, as well as the santa clara valley where we're seeing it a bit unhealthy for those of us that are sensitive to the air quality issues. that to be aware of. sunday, into monday, we have a heat watch in place for the bay area valleys, as well as the mountains. northeast and south bay. low 90s to low 100s in the forecast for sunday and monday. today at this hour, 58 degrees fairfield. 57 in concord. widespread 50s. we've held steady through the morning hours with low clouds overhead. 60 degrees in mountain view. these numbers, anywhere from 2 to 3 degrees from where we started at yesterday at this time. some of us, a few degrees warmer. some of us, a few degrees cooler. by afternoon, most of us warmer. 85 in santa rosa, 84 for movado, 82 san rafael, 72 in sausalito.

from the area. during a similar closure last year, it was considered a success. a nasty shot to the throat during last night's game against san diego. a pitch in the dirt came up and hit buster posey in the throat. it hit him so hard, the ball actually left seam marks on posey's adam's apple. but he's buster posey and he stayed in the game. however, afterwards he could not speak to the media, except to rasp out, "i'm fine." manager bruce bochy will check with posey to see if he needs today off. if you watched last night, you noticed that didn't stop posey from having a good game. giants took on the padres in san diego. top of the second, hunter pence with the infield single. posey scores. giants up 11-0 -- 1-0. giants then up 3-2 after this

double. giants win it 3-1. they will play the padres again tonight at 5:35. oakland a's need to win four of their last five games to earn a spot in the playoffs. that's after an exciting game last night against the mariners in oakland. despite a battle with pink eye for the past two weeks, it was coco crisp who was on the hot streak for the a's. in the 1st inning, crisp hammered this ball into the seats for a solo shot. crisp had three hits, scored three times. a's would go on to beat seattle. final score, 8-2. brandon mccarthy won't pitch again this season. we know that, but he has been cleared to be in the dugout for the a's final home game of the season. he made the announcement yesterday with his first meeting with the media after being hit in the head on september 5th. mccarthy says he can begin limited physical activity and may play catch today before the game. that game starts at 1:05. all eyes will also be on the angels and the rangers, as the a's hope to clinch a playoff

. let's recap some of the top stories we're following for you this morning. a morgan hill woman is behind bars after allegedly abandoning her 10-year-old daughter after a shoplifting attempt. marcy keelin was arrested last night east of reno. she had her 11-month-old son with her. on september 19th, she took her daughter to a safeway store, filled a shopping cart with groceries, then when a store employee confronted the girl, her mom drove off.

nobel peace prize winner makes a stop in the bay area today, on her historic trip to the u.s. she is scheduled to speak at the university of san francisco after being honored at the san francisco freedom forum last night. well, it took firefighters about 15 minutes to put out a fire at the private law office of vallejo mayor osby davis. investigators are now trying to figure out if the fire was deliberately set. christian calf tan is live in vallejo with more. >> reporter: just 15 minutes to put the fire out, but it did an extensive amount of damage to the building. you can see construction workers have now finished sealing up the front part of the building. there is an intensive investigation under way here at the vallejo mayor davis' law offices. crews responded to the fire at about 1:30 this morning and when they arrived, they say there was an intense fire and smoke filling the building. the mayor was here earlier this morning, surveying the damage for himself, as was fellow

attorney michael thompson, who shares this building with the mayor. he tells us by phone that he was devastated by that fire. crews tell me they were able to confine the fire to the waiting area, knock it down in about 15 minutes, which should help with the fire investigation. we earlier this morning saw investigators out here going through the scene with a device that can help them figure out just how this fire started. >> we call it, refer to it as a sniffer. what that does, it will pick up any flammable liquids or other things like that, and that gives an indication of how the fire started, as well as traveled. >> reporter: now, one of the other major tools that may help investigators figure out how this fire started are the various surveillance cameras in the area. they may very well have recorded the images shortly before the fire broke out. now, earlier this morning, we reached out, as we told you, to michael thompson, who told us he is devastated by this fire. he said it is under investigation. we also reached out to mayor

davis. so far, have not heard back from him. we will continue to monitor the story and bring you the latest details. for now, live in vallejo, ktvu channel 2news. police evacuated an east bay park after they say a suicidal man began making threats. that incident happened yesterday afternoon at the san leandro marina park. police took the man to the hospital to be checked out, after he started cutting his arms with a knife. they say a gun he was carrying turned out to be a replica. this morning, michigan police are still working to determine if the body of teamsters leader jimmy hoffa is buried beneath a home in detroit. yesterday, all eyes were on the home, as police removed two soil samples from underneath a shed, acting on a tip from a man dying of cancer who says he saw a body being buried at the home around the time hoffa disappeared. a scan of the area showed something under a concrete slab, but police are not sure what exactly it is. >> it could be a dead body, if

not hoffa, then somebody else, or it could be the root of a tree. who knows? >> police say the soil samples are being tested for traces of human remains and nothing else was found during that dig. hoffa was last seen outside a restaurant in suburban detroit back in 1975. connecticut police say it is going to take weeks to investigate the circumstances surrounding a man who shot and killed his son. authorities say the 15-year-old high school sophomore apparently tried to ransack his own home. he had a knife, wore a ski mask and was dressed all in black. the father didn't know the prowler was his son. the two started fighting each other, right before the father shot and killed him. the boy's classmates say he was a sweet and fun-loving person. the vatican opened the doors today for the public trial of what some say is the most embarrassing scandal for pope benedict xvi. the pope's butler is accused of stealing and leaking information pertaining to the pope, to a

journalist. the 46-year-old paolo gabriel faces 46 years in prison if convicted of aggravated theft. he's already confessed and asked to be pardoned by the pope. bay area commuters will have new options come monday. caltrain is adding two new trains and restoring four others, due to budget restraints. the altamonte commuter express is adding two new trips between the san joaquin and tri valley areas to san jose. caltrain says ridership reached an all-time high in june, leading to standing room-only trains on some routes. we have a transit alert for you this morning, if you plan on riding bart out of pleasant hill. today, bart will be water proofing the track and platforms at the station. they want to complete the work before the winter months. that means there will be no trains on platform 1 this weekend. passengers traveling to pittsburg bay point will need to board from platform number 2. other closures are expected during the next four weekends. it's that time of year again. time to get your flu shot. and today, more than a thousand

. a warning about fake online pharmacies. the fda launched a new campaign to warn the public about the dangers of buying medications online. the fda says the vast majority of internet pharmacies are fraudulent and selling drugs that are fake, expired, or do not contain any active ingredients. some medications have also been found to contain arsenic and even rat poison. a new report finds amtrak employees are failing drug and

alcohol tests at a much higher rate than the rest of the rail industry. the audit from amtrak's office of inspector general found amtrak employees are failing the tests at a 51% higher rate than the industry average. the majority of employees who failed the drug test tested positive for marijuana and cocaine. well, if you're in the market for an electric car, this may be a good time to buy or lease a nissan leaf. nissan is lowering monthly lease prices to $219, from $249, and they are offering discounts due to those slow sales. nissan says it sold more than 4200 leaf this is year through august, but that's almost a third fewer than a year ago. some san francisco residents can visit the california academy of sciences for free this weekend. that's a good price. it's all part of the neighborhood free days, which is every friday through sunday through the end of october. so people living in the zip codes there on your screen can enter for free this weekend. all you have to do is bring your photo id. each adult can bring up to six

children. more than 2000 soccer balls will hopefully be flying in the air out at candlestick today. america scores, a local youth soccer group will gather to try and break the guinness world record for the most soccer balls dribbled at one time. last year, the st. louis chapter made history, when 428 soccer players came together. but the united nations has since defeated that record, with more than 2000 dribblers in the gaza strip. the gates open out at the stick at 1:00 today. even without tiger woods, the u.s. ryder cup team is playing well against the europeans. the former number one golfer in the world, who is currently number two, is sitting out this morning after losing both of his matches yesterday. the team captain says tiger needs a bit of rest and he will play this afternoon. the u.s. is currently leading europe 6 points to 4. los angeles wants pro football back. the l.a. city council is now unanimously approved a plan to build a 72,000-seat stadium in downtown los angeles. it would cost $1.2 billion. unions are in favor because of the jobs it would create.
